THE ROLE OF SOVIET TERRITORY FORMATION PROJECTS IN DETERMINING THE BOUNDARIES OF SETTLEMENT POINTS IN UKRAINE

Abstract

Article analyzes the normative regulation of the process of developing, agreeing and approving projects for the formation of the territory of local councils, as well as their significance and impact on the latest processes of the formation of united territorial communities, including the development of land management projects for establishing the boundaries of the territories of territorial communities.

The primary significance of the projects for the formation of the territory of local councils was the determination in the appropriate coordinate system of the territory of the relevant council and the graphic reflection of the boundaries of settlement within the boundaries of a such council. This, in turn, determined the scope of the powers of the relevant council and other executive bodies for such a territory regarding the disposal of lands of the respective ownership.

In addition, the above-mentioned projects determined the subjects of land use on the date of development of such projects, and also initially determined the categories of land by land users in accordance with the Land Code of Ukraine.

Attention is also focused on the role of local council territory formation projects, which eliminated the problems of cross-strip use of land users in different areas, and also allowed to determine the boundaries of adjacent communities, which prevented the existence of land disputes on the raised issue.

The requirements of normative documents for the preparation of the council territory formation project, as well as the procedure for their coordination and approval, are analyzed, and court practice is shown regarding its application in resolving legal disputes. The council territory formation project are studied and it is emphasized that the catalog of turning points of the outer boundary of the council territory was mentioned only in the first sample of the project for the developer, and not for use by land resources authorities. Some of the land institutes are currently in the process of being terminated. Further, attention is focused on the necessity to preserve the specified council territory formation project with their inclusion in the Fund of Land Management Documentation and entry of data on the specified projects into the state land cadastre.

Recent legislative amendments regarding the expansion of the control functions of local government bodies in resolving land disputes and transferring land to municipal ownership outside settlements boundaries, but within territorial communities of the councils, strengthen the role and significance of council territory formation project.

Current applicable legislation provides that information on the boundaries of administrative-territorial units, which were established before the entry into force of the Law of Ukraine "On Land Management", is included into the State Land Cadastre on the basis of council territory formation project and the establishment of the boundaries of village and settlement councils.
