LEGAL REGULATION OF THE ADMINISTRATIVE PROCEDURE ISSUANCE OF TEMPORARY AND PERMANENT RESIDENCE PERMITS FOR FOREIGNERS IN THE PRC
Abstract
The article is devoted to a comprehensive analysis of the administrative and legal regulation
of the procedure for issuing temporary and permanent residence permits to foreign nationals in
the People’s Republic of China (PRC), examined through the prism of the correlation between
formalized procedures and the discretionary powers of public authorities. It is substantiated that
the residence permit system in the PRC combines clearly regulated administrative mechanisms
with broad administrative discretion vested in public security authorities, which significantly
affects the predictability of law-enforcement practice. It is revealed that high qualification and
eligibility requirements for obtaining permanent residence permits, as well as a centralized three
tier decision-making model, indicate the dominance of public interests and the priority of state
security in the migration policy of the PRC.
