MECHANISM FOR IMPLEMENTING THE RULE OF LAW PRINCIPLE: EFFECTIVENESS AND MEASUREMENT CRITERIA
Abstract
The article provides a comprehensive analysis of the effectiveness of the mechanism for
implementing the principle of the rule of law as a fundamental condition for the functioning of a
democratic state governed by law. It is argued that the effectiveness of the rule of law cannot be
reduced to its formal constitutional or legislative recognition, but should be understood as a
multidimensional phenomenon combining normative-legal, institutional, and socio-legal
dimensions. The study substantiates that assessing the effectiveness of the mechanism for
implementing the rule of law requires a systemic approach based on the correlation between the
objectives of legal regulation and the actual results of its application in legal practice.
The article analyzes key theoretical approaches to the concept of effectiveness in legal
regulation, including the goal–result correlation model, as well as the potential use of analytical
and correlation-based methods to measure the degree of realization of legal values. Internal and
external factors influencing the effectiveness of the rule of law implementation mechanism are
identified, including the quality and coherence of legislation, the institutional capacity and
independence of the judiciary, the level of legal culture, and public trust in legal institutions.
Special attention is paid to effective justice as the core element of the rule of law
implementation mechanism. Based on the case law of the European Court of Human Rights, the
study systematizes institutional, procedural, and outcome-oriented requirements for judicial
proceedings, compliance with which is essential for ensuring genuine protection of human rights
and freedoms.
As a result of the research, the author proposes an original system of criteria for assessing
the effectiveness of the mechanism for implementing the principle of the rule of law, encompassing
normative-legal, institutional, socio-legal, and result-oriented indicators. It is concluded that the
application of this system of criteria enables an objective evaluation of the state of the rule of law,
the identification of structural dysfunctions within the legal system, and the determination of
directions for its further improvement.
