LEGAL FORECASTING AS A TECHNICAL AND LEGAL METHOD OF REGULATING LEGISLATION

Abstract

The article provides a comprehensive analysis of juridical forecasting as an important technical and legal method of streamlining legislation. It is emphasized that juridical forecasting plays an important role in ensuring the quality, efficiency, and effectiveness of law-making activities, as well as the stability, predictability of development, and improvement of the legal system of Ukraine as a whole.

The essence, features, and functional orientation of juridical  forecasting are revealed. It is noted that juridical forecasting is a process of analyzing social relations carried out by relevant entities with the aim of studying legislation and determining the prospects for legal regulation of social relations, improving the efficiency and effectiveness of law-making activities, and streamlining and improving legislation.

The main functions of juridical forecasting have been identified and characterized, namely: analytical, integrative, evaluative-prognostic, predictive-preventive, system-forming, etc.

It is emphasized that juridical forecasting provides an opportunity to identify trends and ways to improve law-making activities, it contributes to the systematic nature of legal regulation and its effectiveness, occupies an important place and plays a certain role in ensuring the effectiveness and efficiency of legislation.

Particular attention is paid to the impact of juridical forecasting on the regulation and improvement of legislation, which is carried out through various forms and types, such as: codification, incorporation and consolidation, systematization, etc.

The conclusions summarize the key points of juridical  forecasting, stating that juridical forecasting is an important component of ensuring the effectiveness, efficiency, consistency and predictability of legislation, and its compliance with international principles and standards.
